These Affiliate Program Terms & Conditions ("Affiliate Terms") govern your participation in the CreatorSense Affiliate Program ("Program") operated by Creator Sense AI Pty Ltd ("CreatorSense", "we", "us", or "our"), a company registered in New South Wales, Australia. By submitting an application, receiving an affiliate link, or earning any commission under the Program, you ("Affiliate", "you") agree to be legally bound by these Affiliate Terms, our Terms of Service, and our Privacy Policy.
If you do not agree to these Affiliate Terms, do not apply to or participate in the Program.
1. Eligibility
1.1 Minimum Requirements
To be eligible to participate in the Program you must:
- Be at least 18 years of age;
- Be a natural person or a properly registered legal entity;
- Have an active, publicly accessible online presence (website, channel, newsletter, social account, or similar);
- Not be an employee, contractor, director, or officer of CreatorSense or any of its related bodies corporate;
- Not be a direct competitor of CreatorSense (i.e., operating a substantially similar creator analytics, creator tax, or creator productivity SaaS product);
- Not reside in a country subject to sanctions administered by the UN Security Council, the US OFAC, the EU, or the Australian Department of Foreign Affairs and Trade ("DFAT") where participation would be unlawful; and
- Have provided accurate, complete, and current information in your application.
1.2 Acceptance at Our Discretion
We review all applications manually. Submission of an application does not guarantee acceptance. We may accept or reject any application for any reason or no reason, at our sole discretion, without liability or obligation to explain our decision.
Acceptance into the Program is not transferable. You may not assign, sub-license, or transfer your affiliate account or any commission entitlement to any third party without our prior written consent.
2. The Affiliate Link and Tracking
2.1 Your Unique Link
Upon approval, we will issue you a unique tracking URL ("Affiliate Link"). You must use this link exclusively for your promotional activities under the Program. You must not modify, obscure, or strip tracking parameters from the Affiliate Link.
2.2 Attribution Model
We use last-click attribution with a 30-day cookie window. A Qualifying Sale (defined in clause 3.1) is attributed to you if the purchasing customer clicked your Affiliate Link within the 30 days preceding their first paid subscription charge, and no other affiliate's link was clicked more recently. We reserve the right to change our attribution model with 30 days' written notice.
2.3 Tracking Limitations
We are not responsible for commissions lost due to a customer's browser settings, ad blockers, private browsing modes, cookie restrictions, or third-party tracking prevention. We will not manually credit sales that cannot be verified through our tracking system, except at our sole discretion in cases of clear documented error.
3. Commissions
3.1 Qualifying Sales
A "Qualifying Sale" means a new paid Pro subscription to any CreatorSense Chrome extension ($7/month), where:
- The subscriber was referred by your Affiliate Link within the applicable cookie window;
- The subscriber is a new customer — not a person who previously held a paid subscription to the same product under any account;
- The subscriber is not you, a family member, a household member, an employee, a contractor, or any person acting in concert with you;
- The subscription has not been cancelled, refunded, or charged back; and
- The sale is not otherwise disqualified under these Affiliate Terms.
Free tier sign-ups, trial periods, and gift subscriptions do not constitute Qualifying Sales and earn no commission.
3.2 Commission Rate
You earn 30% of the net subscription revenue received by CreatorSense for each Qualifying Sale, per billing cycle the subscription remains active. "Net subscription revenue" means the subscription charge actually collected by CreatorSense after deducting payment processing fees (typically 2–3% plus a fixed fee charged by Stripe). The current gross price is $7/month per extension, resulting in an approximate commission of $2.10 per active subscription per month.
3.3 Recurring Commissions
Commissions are recurring: you continue to earn 30% of net subscription revenue for each billing cycle a referred subscriber remains on an active paid plan, subject to these Affiliate Terms and provided your affiliate account remains in good standing. Recurring commissions cease immediately upon termination of your affiliate account for any reason.
3.4 Commission Hold Period
All commissions are subject to a 30-day hold period from the date of the underlying subscription charge. This hold allows us to process refund and chargeback claims before commissions are paid. Commissions on a charge are not eligible for payment until the hold period has elapsed and the charge remains valid.
3.5 Minimum Payout Threshold
Commissions are paid monthly, in arrears, once your cleared commission balance reaches a minimum of $50 USD. If your cleared balance is below $50 at the end of a payment cycle, it rolls over to the next cycle. Balances that remain below $50 for 12 consecutive months may, at our discretion, be forfeited.
3.6 Payment Method
Commissions are paid via Stripe to the bank account or payment method on file in your affiliate account. You are responsible for providing accurate, current payment details. We are not liable for payments made to an incorrect account you provided. You are solely responsible for any fees charged by your bank or payment provider.
3.7 Currency
All commissions are calculated and paid in United States Dollars (USD).
4. Retention Bonuses
4.1 Bonus Tiers
In addition to recurring commissions, you may qualify for a quarterly retention bonus based on the number of active paid subscribers attributable to your Affiliate Link at the end of a qualifying quarter ("Quarter End"):
- 10–24 active subscribers at Quarter End: $25 USD bonus
- 25–49 active subscribers at Quarter End: $75 USD bonus
- 50–99 active subscribers at Quarter End: $150 USD bonus
- 100 or more active subscribers at Quarter End: $300 USD bonus
Only the highest applicable tier applies in any given quarter. Bonuses are not stackable across tiers.
4.2 Qualifying Conditions
To qualify for a retention bonus in a quarter:
- Your affiliate account must be in good standing and not under investigation at Quarter End;
- The active subscriber count is calculated across all CreatorSense Chrome extensions combined, counting only subscribers whose subscriptions were active and paid on the final day of the quarter;
- Subscribers who are within the 30-day hold period on Quarter End are excluded from the count until their hold clears; and
- Any subscriber whose account is flagged for fraud or whose payment is in dispute is excluded from the count pending resolution.
4.3 Bonus Payment Timing
Qualifying bonuses are calculated within 15 business days following the end of each calendar quarter (31 March, 30 June, 30 September, 31 December) and are paid in the next regular commission payment cycle following calculation.
4.4 Bonus Clawback
If, following payment of a retention bonus, we determine that the subscriber count used to calculate the bonus was inflated due to fraud, abuse, or a breach of these Affiliate Terms, we reserve the right to deduct the overpaid bonus amount from future commission payments or to require repayment within 30 days of written notice.
5. Prohibited Conduct
The following conduct is strictly prohibited and will result in immediate termination of your affiliate account, forfeiture of all unpaid commissions, and may result in legal action:
5.1 Self-Referrals and Related-Party Referrals
You must not use your Affiliate Link to sign up for a subscription yourself, or to sign up family members, household members, employees, contractors, or any person acting at your direction or in concert with you. All Qualifying Sales must be genuine arm's-length transactions with unrelated third parties.
5.2 Fake or Fraudulent Accounts
You must not create, encourage, or facilitate the creation of fake subscriber accounts, temporary payment methods, or subscriptions that are intended to be cancelled after the commission tracking period. We monitor subscriber retention and churn patterns; abnormally high churn rates among your referred subscribers are a strong indicator of fraud and will trigger an investigation.
5.3 Cookie Stuffing and Click Injection
You must not engage in cookie stuffing, click injection, or any technique that causes our tracking cookie to be set on a user's browser without that user's genuine, voluntary interaction with your Affiliate Link. This includes embedding the Affiliate Link in iframes, using redirects, auto-loading scripts, or any other method designed to create a tracking attribution without user intent.
5.4 Spam and Unsolicited Communication
You must not promote your Affiliate Link through unsolicited email, SMS, or messaging (spam). All promotional communications must comply with applicable anti-spam laws including the Australian Spam Act 2003, the US CAN-SPAM Act, and the EU GDPR where applicable.
5.5 False and Misleading Claims
You must not make false, misleading, or deceptive claims about CreatorSense products, pricing, features, or results. You must not represent earnings guarantees or make claims that we have not expressly authorised in writing. All promotional material must comply with applicable consumer protection laws, including the Australian Consumer Law.
5.6 Paid Search and Brand Term Bidding
You must not run pay-per-click (PPC) or paid search advertising that bids on "CreatorSense", "Creator Sense AI", or any confusingly similar brand terms, product names (e.g., "ClipPitch", "AffiliateKit", "Tax Mini", "UGC Starter Kit", "Digital Product Quickstart"), or misspellings of these terms. Violation of this clause will result in immediate termination and forfeiture of all commissions.
5.7 Coupon and Discount Misrepresentation
You must not list your Affiliate Link on coupon, deal, or cashback sites without our express prior written consent. You must not represent that a discount or coupon exists when none has been authorised.
5.8 Competitor Promotion
You must not use your affiliate marketing for CreatorSense to simultaneously promote a direct competitor's product in a way that directs users away from CreatorSense (e.g., publishing "CreatorSense vs [Competitor]" content that ultimately recommends the competitor).
5.9 Prohibited Content
You must not promote your Affiliate Link on websites or channels that contain or promote:
- Illegal content or activities;
- Hate speech, discrimination, or violence;
- Content directed at children under 13;
- Adult content without appropriate age-gating; or
- Content that, in our sole opinion, is harmful to the CreatorSense brand or reputation.
6. Disclosure Obligations
You must clearly and conspicuously disclose your material connection to CreatorSense in every promotional piece of content that includes your Affiliate Link, in compliance with applicable laws and guidelines, including:
- The US Federal Trade Commission (FTC) Endorsement Guides;
- The UK Advertising Standards Authority (ASA) guidelines;
- The Australian Competition & Consumer Commission (ACCC) influencer marketing guidelines; and
- Any platform-specific disclosure requirements (e.g., YouTube, Instagram, TikTok).
An acceptable disclosure is clear, upfront, and uses plain language such as: "This is an affiliate link — I earn a commission if you subscribe." Burying the disclosure at the end of a video or description, or using ambiguous language such as "#ad" without context, may not satisfy applicable requirements.
7. Brand and Intellectual Property
7.1 Limited Licence
We grant you a non-exclusive, non-transferable, revocable, royalty-free licence to use the CreatorSense name, logo, and approved product images solely for the purpose of promoting the Program in accordance with these Affiliate Terms and any brand guidelines we provide.
7.2 Restrictions
You must not:
- Modify, distort, or alter our logos or brand assets;
- Use our brand assets in a way that implies endorsement, partnership, or employment beyond participation in the Program;
- Register any domain name, social media handle, or business name that incorporates our trademarks or any confusingly similar term;
- Create derivative works, parody accounts, or fan pages that could be confused with official CreatorSense channels without our express written consent.
7.3 Ownership
All intellectual property in CreatorSense products, branding, and materials remains exclusively owned by Creator Sense AI Pty Ltd. These Affiliate Terms do not transfer any ownership rights to you.
8. Refunds, Chargebacks, and Reversals
If a subscriber who generated a commission for you cancels and receives a refund, initiates a chargeback, or their payment is reversed for any reason, the corresponding commission is reversed and deducted from your payable balance. If a reversal results in a negative balance, we reserve the right to offset the negative amount against future commissions or to invoice you for the shortfall, payable within 30 days.
9. Fraud Investigation and Commission Withholding
We actively monitor traffic quality, conversion rates, subscriber retention, and other signals to detect fraudulent activity. If we have reasonable grounds to suspect fraud, abuse, or a breach of these Affiliate Terms, we may:
- Immediately suspend commission payments pending investigation;
- Withhold commissions for up to 90 days while we investigate;
- Permanently withhold commissions from transactions we determine to be fraudulent;
- Terminate your affiliate account with immediate effect; and/or
- Pursue civil or criminal legal action and seek damages, including recovery of any commissions already paid that were based on fraudulent activity.
Our determination of fraud is final, subject only to a written dispute process described in clause 16. We are not required to share the specifics of our fraud detection methods.
10. Changes to the Program
We reserve the right to modify the commission rate, bonus structure, cookie window, payment threshold, attribution model, or any other aspect of the Program at any time. For material changes that reduce your commission rate or alter your bonus entitlements, we will provide at least 30 days' written notice via the email address on your affiliate account before the change takes effect. Your continued participation in the Program after the effective date of any change constitutes your acceptance of the revised terms.
We reserve the right to suspend or permanently terminate the Program at any time. In the event of program termination, we will pay all validly earned commissions that have cleared the hold period within 60 days, subject to verification and these Affiliate Terms.
11. Term and Termination
11.1 Duration
These Affiliate Terms commence on the date your application is approved and continue until terminated by either party.
11.2 Termination by You
You may terminate your participation at any time by notifying us in writing at support@creatorsenseai.com. Termination does not affect commissions already earned on Qualifying Sales that occurred before your termination date, subject to the hold period and these Affiliate Terms.
11.3 Termination by Us
We may terminate your participation in the Program:
- With 30 days' notice for any reason or no reason;
- Immediately and without notice for any breach of these Affiliate Terms, our Terms of Service, applicable law, or our brand guidelines; fraudulent or abusive conduct; inactivity (no referred Qualifying Sales for 12 consecutive months); or conduct that we determine to be damaging to CreatorSense.
11.4 Effect of Termination
Upon termination for any reason, your Affiliate Link is deactivated immediately. Recurring commissions on previously referred subscribers cease on the date of termination. Where termination is for cause (i.e., breach or fraud), all unpaid commissions, including those that have cleared the hold period, may be forfeited at our sole discretion. We will pay cleared commissions on a with-cause termination only where we are satisfied, acting reasonably, that the relevant referrals were genuine and compliant.
11.5 Inactive Accounts
If your affiliate account generates no Qualifying Sales for 12 consecutive months, we may deactivate your account and forfeit any balance below the minimum payout threshold, with 30 days' prior written notice.
12. Relationship of the Parties
You are an independent contractor. Nothing in these Affiliate Terms creates an employment, agency, partnership, joint venture, or franchise relationship between you and CreatorSense. You have no authority to bind CreatorSense in any agreement, representation, or warranty. You are solely responsible for your own business operations, costs, taxes, and legal compliance.
13. Tax Obligations
You are solely responsible for all taxes, levies, and duties arising from your participation in the Program, including income tax, GST/VAT, and self-employment taxes applicable in your jurisdiction. We will not withhold taxes from commission payments unless required by law. Where required by applicable law or our payment processor, you must provide a valid tax identification number, W-9 (US), W-8BEN (non-US), or equivalent documentation before commissions can be paid. Failure to provide required tax documentation will result in suspension of payments until the documentation is received.
14. Confidentiality
You agree to keep confidential any non-public information disclosed to you in connection with the Program, including internal commission rates beyond those publicly stated, fraud detection methods, business strategy, and subscriber data. You must not disclose confidential information to any third party without our prior written consent, and must use it only for the purpose of participating in the Program.
15. No Earnings Guarantee
We make no representation, warranty, or guarantee regarding the amount of commission you will earn under the Program. Any income figures used in marketing materials are illustrative examples only and do not represent typical or expected results. Your actual earnings will depend on your audience, promotional methods, and the conversion and retention rates of your referred subscribers.
16. Limitation of Liability
To the maximum extent permitted by law:
- CreatorSense's total aggregate liability to you under or in connection with the Program (whether in contract, tort, negligence, or otherwise) is limited to the total commissions paid to you in the three months preceding the event giving rise to the claim;
- CreatorSense is not liable for any indirect, consequential, special, incidental, or punitive loss or damage, including loss of profit, loss of revenue, or loss of business opportunity; and
- CreatorSense is not liable for any failure or delay caused by circumstances beyond our reasonable control, including technical failures, payment processor outages, or platform changes.
Nothing in these Affiliate Terms limits liability for fraud, wilful misconduct, death, or personal injury caused by negligence, or any liability that cannot lawfully be excluded.
17. Indemnification
You agree to indemnify, defend, and hold harmless CreatorSense and its directors, officers, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from or relating to: (a) your breach of these Affiliate Terms; (b) your promotional activities; (c) your violation of any applicable law or third-party rights; or (d) any claim by a third party arising from your promotional content.
18. Dispute Resolution
If a dispute arises in connection with these Affiliate Terms, the parties agree to attempt to resolve it through good-faith negotiation within 30 days of written notice from either party. If the dispute is not resolved within that period, either party may refer the matter to mediation administered by the Resolution Institute (Australia) before commencing court proceedings. Nothing in this clause prevents either party from seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction.
19. Governing Law and Jurisdiction
These Affiliate Terms are governed by the laws of New South Wales, Australia. Each party submits to the exclusive jurisdiction of the courts of New South Wales, Australia, and any courts competent to hear appeals from those courts, in connection with any dispute relating to these Affiliate Terms.
20. General
20.1 Entire Agreement
These Affiliate Terms, together with our Terms of Service and Privacy Policy, constitute the entire agreement between you and CreatorSense regarding the Program and supersede all prior representations, agreements, and understandings.
20.2 Severability
If any provision of these Affiliate Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
20.3 Waiver
Our failure to enforce any provision of these Affiliate Terms does not constitute a waiver of our right to enforce it in the future.
20.4 Notices
Notices to us should be sent to support@creatorsenseai.com. We will send notices to the email address associated with your affiliate account. Notices are deemed received 24 hours after sending.
20.5 Assignment
You may not assign or transfer any of your rights or obligations under these Affiliate Terms without our prior written consent. We may assign our rights and obligations under these Affiliate Terms to a successor entity in connection with a merger, acquisition, or sale of all or substantially all of our assets.
