CreatorSense AI is a business analytics platform for content creators that:
- Connects to social media platforms via OAuth
- Displays unified analytics across platforms
- Provides AI-powered insights and recommendations
- Offers content scheduling and management tools
3. Account Registration
3.1 Requirements
To use the Service, you must:
- Be at least 18 years old
- Provide accurate and complete registration information
- Accept these Terms of Service and our Privacy Policy
- Maintain the security of your account credentials
- Promptly update your information if it changes
3.2 Account Security
You are responsible for:
- All activity that occurs under your account
- Maintaining the confidentiality of your password
- Notifying us immediately of any unauthorized access

5. Subscription and Payment
5.1 Plans
We offer various subscription plans:
- Free Tier: Limited features and platform connections
- Standard: Enhanced features and analytics
- Professional: Full access to all features
5.2 Billing
- Subscriptions are billed in advance (monthly or annually)
- Payment is processed through Stripe
- Prices may change with 30 days' notice
5.3 Refunds
- Annual subscriptions: Pro-rated refund within first 30 days
- Monthly subscriptions: No refunds for partial months
- Free trial cancellations: No charge
5.4 Overage Charges
If you enable "Continue after limits reached," you agree to pay overage charges at the standard overage rate.
6. Acceptable Use
6.1 You May NOT:
- Use the Service for any illegal purpose
- Attempt to access other users' accounts or data
- Reverse engineer, decompile, or disassemble the Service
- Circumvent any security measures
- Resell or redistribute the Service without authorization
- Use automated means to access the Service (except approved APIs)
- Submit false or misleading information
6.2 Content Standards
You will not use the Service to:
- Distribute malware or harmful code
- Infringe on intellectual property rights
- Harass, abuse, or harm others
- Spread misinformation or spam
7. Intellectual Property

CreatorSense AI and its features, functionality, and content are owned by us and protected by copyright, trademark, and other intellectual property laws.
7.2 Your Rights
You retain all rights to your content and Platform Data. By using the Service, you grant us a limited license to display and process your data solely to provide the Service.
7.3 Feedback
Any feedback, suggestions, or ideas you provide may be used by us without compensation or attribution.
8. Third-Party Services
8.1 Platform Providers
The Service integrates with third-party platforms (Facebook, YouTube, etc.). Your use of those platforms is governed by their respective terms of service.
8.2 Payment Processing
Payment is processed by Stripe. Their terms apply to payment transactions.
8.3 No Endorsement
Integration with third-party services does not constitute endorsement by those providers.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF DATA
We do not guarantee:
- Uninterrupted or error-free service
- Accuracy of analytics data from third-party platforms
- Specific results from using the Service
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
10.1 Exclusion of Damages
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:
- Loss of profits or revenue
- Loss of data
- Loss of business opportunities
- Costs of substitute services
10.2 Cap on Liability
Our total liability shall not exceed the greater of:
- The amounts you paid us in the 12 months preceding the claim, or
- $100 USD
10.3 Exceptions
These limitations do not apply to liability for:

11. Indemnification
You agree to indemnify, defend, and hold harmless CreatorSense AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

- Your content or data
12. Termination
12.1 By You
You may terminate your account at any time through Settings or by contacting support.
12.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Fail to pay subscription fees
- Harm other users or the Service
12.3 Effect of Termination
Upon termination:
- Your access to the Service will end
- We will delete your Platform Data per our Privacy Policy
- Certain provisions survive termination (Sections 7, 9, 10, 11, 13)
13. Dispute Resolution
13.1 Informal Resolution
Before filing a formal dispute, contact us at support@creatorsenseai.com. We will attempt to resolve the issue within 30 days.
13.2 Governing Law
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.
13.3 Jurisdiction
Any disputes shall be resolved in the courts of New South Wales, Australia.
14. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes via:

- Updated "Last Modified" date
Your continued use after changes constitutes acceptance.
15. Communications and Marketing
15.1 Service Communications
By creating an account, you agree to receive essential service communications including:

- Platform connection status notifications
These communications cannot be opted out of while maintaining an active account.
15.2 Marketing Communications
If you opt in to our newsletter during registration or later:

- You can unsubscribe at any time via the link in any email or in Settings
We will never share your email with third parties for marketing purposes.

16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

16.4 Assignment
You may not assign these Terms without our consent. We may assign freely.
